Terms and Conditions

CasaTIMS applies the following general terms and conditions, which are effective from the moment of reservation until the stay at Casa TIMS.

1. Definitions

The capitalized terms in these general terms and conditions have the following meanings:

- Accommodation: Casa TIMS, located at Partida Canuta Alta 9A in Calpe. Legally represented by Mr. T. Waterschoot and Mrs. H. van de Kruijs, hereinafter referred to as "Owners" or "Owner."

- The owners/owner may be replaced by a manager.

- Guest/guests: a person/people staying at the accommodation and registered as such.

- Third parties: individuals not registered as guests.

- Main guest: the person who has reserved at Casa TIMS (on behalf of other guests). The main guest must be over 18 years old and is responsible for his/her fellow guests.

- Manager: the person managing Casa TIMS, which can be the owners or a person managing the accommodation on their behalf.

- Reservation: a confirmation of the reservation request by Casa TIMS.


 2. General

   2.1 These general terms and conditions apply to all offers, quotations, orders, legal relationships, and agreements, referred to as "the stay at the accommodation."

   2.2 Deviations from and additions to these general terms and conditions are only valid if expressly and in writing agreed upon, such as in a written agreement or order confirmation.

   2.3 In case of conflicting conditions between these general terms and conditions and the order confirmation, the conditions included in the order confirmation apply.

   2.4 Guests must follow all instructions from the manager in all cases.

   2.5 The manager reserves the right to deny access to the accommodation and/or refuse guests, without further notice, refund of accommodation costs, and without stating reasons in case of violation of these General Terms and Conditions or inappropriate behavior.

   2.6 Guests must adhere to the house rules of the accommodation.

   2.7 The administration of the accommodation is decisive in case of any disagreement unless the guest can prove otherwise.

   2.8 Children are welcome in the accommodation from the age of 12.

   2.9 Guests must present identification upon arrival and have a fixed place of residence.


 3. Arrival and Departure

   3.1 Check-in is possible from 3:00 PM, and check-out must be completed by 10:30 AM at the latest.

   3.2 A late check-out is possible upon agreement, provided the room is not reserved on the day of departure. An additional fee may apply.

   3.3 Key handover and check-in take place on the day of arrival. Guests are asked to inform the manager about their approximate arrival time for a smooth check-in process.

   3.4 If guests arrive before 3:00 PM, they can drop off their luggage.

   3.5 No refund will be given in case of premature departure.


 4. Rates, Reservation, and Payment

   4.1 Room rates are listed on www.casatims.com and/or on booking websites featuring the accommodation. Prices include VAT, tourist tax, towels, bed linen, air conditioning, internet, pool, TV, water, electricity, and final cleaning (under normal use -> see exception in article 7.4).

   4.2 Rates do not include the costs of cancellation or travel insurance and/or other expenses.

   4.3 All information regarding rates on the website www.casatims.com and/or on a platform where the accommodation is listed is assumed to be provided in good faith and is always subject to interim adjustments. The accommodation is not bound by obvious errors.

   4.4 Minimum stay during high season (June to September) is 7 nights, and in low season (October to May), a minimum of 3 nights.

   4.5 A reservation is preferably made via the booking module on www.casatims.com or through a platform like booking.com. Alternatively, a reservation request can be submitted by email and/or phone. In the case of a reservation request by email or phone, the reservation becomes final only after written confirmation from the accommodation.

   4.6 For individuals, payment of the total reservation is due 14 days before arrival. In case of reservations with arrival within 2 weeks, payment is due immediately. If payment is not received, the reservation will be canceled.

   4.7 It is possible to request a VAT invoice. This request can be made by email to info@casatims.es.


 5. Cancellation Policy

   5.1 The following conditions apply in case of reservation cancellation:

- Free cancellation is possible up to 14 days before arrival.

- Cancellation within 14 days before the arrival date or no-shows, 100% of the total reservation will be charged.


 6. Accommodation Liability

   6.1 The accommodation is not liable for damage, loss, or theft of guests' belongings. In case of disputes, all (legal) costs are borne by the guests.

   6.2 All risks related to the stay in the accommodation are the responsibility of the guests, and the owners cannot be held liable for personal injury resulting from a stay in the accommodation.


 7. Damage and Deposit Payment

   7.1 Upon arrival, guests are required to pay a €300 deposit per reservation, but the damage amount is not limited to this. The deposit can be paid in cash or by card and will be refunded at check-out if everything is in order.

   7.2 Damage caused by guests to the accommodation must be reported immediately to the manager. Repair or replacement costs must be reimbursed immediately by the guest. If, after check-out and refunding the deposit, it is found that there is damage to movable or immovable property, the invoice for the repair and/or replacement costs will still be issued.

   7.3 In case of loss or non-return of the accommodation keys, all resulting costs will be charged to the main guest. For each non-returned key, €25 will be deducted from the deposit or invoiced to the guest within 14 days.

   7.4 If the accommodation requires intensive cleaning due to non-normal use by guests, these additional cleaning costs will be charged to the main guest through the deposit and/or an invoice to be paid within 14 days.

   7.5 The deposit will not be fully refunded if guests do not adhere to the following points:

- Waste – Remove all waste/clutter from the accommodation and dispose of it in the containers on the street.

- Refrigerator – Empty the refrigerator and freezer.

- Kitchen – Wash all kitchen items and return them to their original place.


 8. House Rules

   8.1 Smoking is only allowed on the terrace, and cigarette butts must only be extinguished in the designated ashtrays. Fire hazards are the responsibility of the guests.

   8.2 Third parties are not welcome in the accommodations and/or the common areas of the accommodation.

   8.3 Pets are not allowed.

   8.4 The use of the pool is not allowed between 10:00 PM and 7:30 AM.

   8.5 Between 10:00 PM and 9:00 AM, guests are requested not to make noise or listen to loud music to avoid disturbing other guests and neighbors.

   8.6 A fee of at least €300 will be charged for improper use of fire extinguishing equipment.

   8.7 It is not allowed to stay in one of the studios with more than 2 people or in the apartment with more than 4 people.

   8.8 The available BBQ can be used upon request.

   8.9 The accommodation must be kept tidy at all times.

   8.10 Burning candles in the accommodation is not allowed.

   8.11 Parking is free on the street. There is space for one vehicle on the driveway directly in front of the accommodation. Parking is only allowed without blocking access.


 9. Force Majeure

   9.1 In the event of force majeure, both permanent and temporary, the accommodation is entitled to wholly or partially terminate the agreement or temporarily suspend it without the guest being entitled to claim performance and/or compensation. Force majeure includes, among other things, but is not limited to: illness or death of the owners, damage to the accommodation due to storm, fire, or otherwise, making normal use of the accommodation (temporarily) impossible, extreme weather conditions, disruptions in the power circuit, government measures, or unforeseen sale.

   9.2 In case of complete or partial termination, the owner will offer an alternative as soon as possible. If this is not possible or the guest does not accept the offered alternative, the already made payment will be fully or partially refunded without any obligation to pay compensation.


 10. Privacy

   10.1 The accommodation will treat all provided or known personal data confidentially and will not freely provide them to third parties. Further explanation can be found in the privacy statement on our website www.casatims.com.

 

 11. Complaints

11.1 Casa TIMS aims to make your stay as pleasant as possible. In case of any complaints, despite our best efforts, guests can report them directly to the manager or via phone and/or email at info@casatims.es. We will do our best to offer a solution as quickly as possible.
